NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

(NOI/RROF) FOR NEWSPAPER PUBLICATION BY RESPONSIBLE ENTITIES

CERTIFYING ENVIRONMENTAL REVIEW

TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:

Notice of Intent to Request a Release of Funds

The County of Delaware gives notice that it will submit a request for release of grant funds and an environmental certification pertaining thereto to the Office of Community Renewal (OCR) on or about January 3, 2014. Comments on the environmental review will be received at the address above until January 2, 2014. The request and certification relate to the following program.

Program Title: Data Control Group, LLC

Location: Bard-Parker Road, Hancock, Delaware County, New York

Purpose of Project: Data Control Group, LLC ("DCG") will undertake a project to renovate a portion of the vacant, former Becton Dickinson manufacturing facility located on Bard-Parker Road in the Town of Hancock. Phase one of this project will allow for DCG to retro-fit a portion of the building for the development of a call center operation. The financial assistance provided through the grant awarded to the County of Delaware will be used to offset $600,000 of DCG’s expenditures for the acquisition of furniture, fixtures and equipment, workforce development and working capital costs.

Estimated Cost: $2,810,000

County of Delaware will undertake the program described above with New York State Community Development Block Grant funds from the U.S. Department of Housing and Urban Development (HUD) under the Title I of the Housing and Community Development Act of 1974, as amended. County of Delaware is certifying to OCR that the County of Delaware and Glenn Nealis in his official capacity as Certifying Officer consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision-making, and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon OCR’s approval, funds may be used for this program, and HUD will have satisfied its responsibilities under the National Environmental Policy Act of 1969 and other related laws and authorities. OCR will accept an objection to its approval of the release of funds and acceptance of the certification only if it is on one of the following bases:

a) that the certification was not in fact executed by the chief executive officer or other officer of applicant approved by HUD; or

b) that applicant’s environmental review to the RROF for the project omitted a required decision, finding, or step applicable to the project in the Environmental Review Process; or
