PLEASE TAKE NOTICE that pursuant to an Interlocutory Judgment in the
above-captioned action, made by Hon. Molly Reynolds Fitzgerald,
Justice, dated August 13, 2008 and Entered in the Delaware County
Clerk’s Office on August 21, 2008, I, Thomas Hegeman, Esq., the
undersigned Referee named in the Interlocutory Judgment, will sell
in one parcel at public auction on Friday, October 24, 2008 at 1:15
P.M. at the front entrance of the Delaware County Courthouse, Court
Street, Delhi, New York, the premises described in said Judgment,
which is situate on Burnwood Road in the Town of Hancock, Delaware
County, New York subject to any state of facts which an accurate
survey might show and to covenants, restrictions, reservations,
easements, leases and agreements of record, if any, and any
violations thereof, if any, and to the rights of the public to
Burnwood Road, and said premises is more particularly described as
follows:
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Hancock,
County of Delaware and State of New York and more particularly
described on the Tax Rolls of the Town of Hancock, Delaware County,
New York in the year 1931 as follows:
Situate in school district No. 17, Lot 19, Spooner tract, Great Lot
4, Hardenburgh Patent, bounded on the north by lands of Signor, on
the east by lands of Wilbur, on the south by lands of O’Dell, on the
west by lands of Peak, containing 50 acres more or less.
Being the same premises described in a deed from R.W. Marks, as
County Treasurer of the County of Delaware, State of New York to
Emma Dennelli dated October 15, 1932 and recorded in the Delaware
County Clerk’s Office on July 15, 1977 in Liber 573 of Deeds at page
777.

at Elk Brook in the Town of Hancock
When: Thursday, October 16, 2008 6:30 p.m.
Where: East Branch Fire Hall

The meeting will start with an informational session. This will
include an overview of the status of this project covering the
design process, project details, scheduling and costs.
Questions/Comments from the public will be welcomed. Attendance of
property owners in the vicinity of the project is encouraged.
Following the informational session, a formal Public Hearing will be
convened to receive formal comments.

Project Description: The applicant proposes to construct an access
road to provide access to a proposed telecommunications facility. A
2,700 foot by 20 foot access road will be constructed which will
result in approximately 2,214 square feet of federal wetland being
permanently impacted with fill and the installation of culverts in
unnamed waterway. The project is located off Doyle Road.
Availability of Application Documents: Filed application documents,
and Department draft permits where applicable, are available for
inspection during normal business hours at the address of the
contact person. To ensure timely service at the time of inspection,
it is recommended that an appointment be made with the contact
person. State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact
on the environment. A Negative Declaration is on file. A coordinated
review was not performed. SEQR Lead Agency: None Designated. State
Historic Preservation Act (SHPA) Determination: Cultural resources
lists and map have been checked. No registered, eligible or
inventoried archaeological sites or historic structures were
identified at the project location. No further review in accordance
with SHPA is required. Availability for Public Comment: Comments on
this project must be submitted in writing to the Contact Person no
later than 10/23/2008 or 15 days after the publication date of this
notice, whichever is later.
